Terms of Service

1. Agreement to Terms

By accessing or using Elorix ("Service"), operated by Atoma Insights, Inc. ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

Elorix is a creator intelligence platform that provides AI-powered content analysis, video generation, trend detection, and monetization recommendations for short-form video creators and teams. The Service includes web-based tools, APIs, and scheduled background processing.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 18 years old or the age of legal majority in your jurisdiction. One person or legal entity may not maintain more than one free account.

4. Billing, Payment & Refund Policy

Paid plans are billed in advance on a monthly or annual basis. All fees are stated in US dollars and are non-refundable except as required by applicable law.

  • No refunds for partial periods. When you cancel a subscription, you retain access to paid features through the end of your current billing period. No pro-rated refunds or credits are issued for the remaining time.
  • No refunds for downgrades. If you switch to a lower-priced plan, the new price takes effect at the start of the next billing cycle. No refund or credit is issued for the difference.
  • Annual subscriptions. Annual plans are non-refundable after the first 24 hours following initial purchase. Within the first 24 hours, you may request a full refund by contacting support.
  • Failed payments. If a payment fails, we may retry the charge and/or restrict access to paid features until the balance is resolved.
  • Price changes.We may change pricing with 30 days' notice. Existing subscriptions are honored through the end of their current billing period.

5. Cancellation

You may cancel your subscription at any time from the billing settings page. Cancellation takes effect at the end of your current billing period. After cancellation, your account reverts to the Free plan. We do not delete your data upon cancellation, but certain features become unavailable.

6. Intellectual Property

Your content. You retain ownership of all content you upload, create, or generate through the Service. You grant us a limited license to process, store, and analyze your content solely to provide the Service.

Our service. Elorix, its design, code, models, and documentation are owned by Atoma Insights, Inc. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Acceptable Use

You agree not to:

  • Use the Service to generate illegal, deceptive, or harmful content
  • Attempt to circumvent rate limits, usage quotas, or access controls
  • Share account credentials or resell access to the Service
  • Use automated means to scrape or extract data from the Service
  • Interfere with the operation of the Service or other users' experience

We reserve the right to suspend or terminate accounts that violate these terms.

8. AI-Generated Content

The Service uses artificial intelligence to generate scripts, voiceovers, images, and recommendations. AI outputs may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing all generated content before publishing. We make no guarantees about the accuracy, quality, or suitability of AI-generated outputs. Content produced with Elorix may be AI-generated or AI-assisted; you are responsible for complying with each platform's AI-content disclosure requirements, and Elorix applies platform-required disclosures on your behalf where supported.

9. No Guarantee of Income or Results

Elorix provides tools and recommendations for content creation and distribution. We make NO guarantee of income, revenue, audience growth, monetization eligibility, or any specific outcome. Results depend on your own effort, the value of the content you choose to create, your own decision-making, and each platform's independent assessment of your content. Any income figures, estimates, or projections shown in the product are estimates for planning purposes only and are not promises of earnings.

10. Analysis of Third-Party Content

When you submit a link for analysis, Elorix may transiently retrieve the referenced media solely to compute analytical results (transcripts, structural analysis). Retrieved media is deleted after processing, is not stored, and is never included in generated output. You are responsible for using analysis results in compliance with applicable law and platform terms.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMA INSIGHTS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, SPECIFIC RESULTS, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.

13. Termination

We may suspend or terminate your access at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections regarding IP, liability, and disputes survive termination.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive the right to participate in class actions.

15. Anonymized Cross-Creator Learning

To improve the Service for all creators, Elorix learns from measured outcomes across its user base. By default, when your channels publish or generate content, Elorix derives anonymized, pattern-level signals from it (for example, hook archetype, dopamine scores, and retention percentages, bucketed by niche and platform) and pools them into shared benchmarks. These pooled signals are k-anonymized — exposed only once a bucket contains at least 10 events from at least 5 distinct accounts — and never include your video content, scripts, titles, account name, or any information that identifies you or your channel. We do not use your content to train AI models that serve other customers.

This contribution is on by default, and you may opt out of it per channel at any time from Settings → Privacy (the “Cross-product benchmarking” section). Opting out does not reduce or degrade any feature built from your own data. See our Privacy Policy §12 for full details.
